dc.description.abstractPraktik Illegal, Unreported, and Unregulated (IUU) fishing merupakan ancaman serius bagi kelestarian sumber daya laut. Kasus penangkapan kapal M/V Volga berbendera Rusia oleh Australia dan persidangannya di International Tribunal for the Law of the Sea (ITLOS) memberikan preseden penting dalam hukum laut internasional terkait pengejaran seketika (hot pursuit), penetapan uang jaminan (reasonable bond), pembebasan segera (prompt release), serta perampasan aset (forfeiture). Penelitian ini bertujuan untuk mengidentifikasi celah hukum perikanan Indonesia dengan membandingkan praktik penegakan hukum dalam kasus M/V Volga terhadap sistem peradilan nasional. Penelitian ini menggunakan metode hukum normatif dengan pendekatan doktrinal dan komparatif, yang dianalisis menggunakan gap analysis. Hasil penelitian menunjukkan bahwa mekanisme penegakan hukum Indonesia masih memiliki kelemahan prosedural jika disandingkan dengan standar UNCLOS 1982 dan yurisprudensi kasus Volga. Pelaksanaan hot pursuit nasional masih bersifat umum dan belum seteknis Pasal 111 UNCLOS. Terkait penetapan uang jaminan, meskipun secara normatif diakui dalam Pasal 104 UU Perikanan, ketiadaan Peraturan Pemerintah (PP) membuat mekanisme ini tidak dapat diterapkan. Di sisi lain, tata kelola lelang barang bukti lekas rusak melalui Pasal 45 KUHAP (UU No. 8 Tahun 1981) memiliki kesamaan fungsi dengan sistem trust di Australia, meski implementasinya masih terhambat birokrasi. Disimpulkan bahwa Indonesia perlu mempertahankan paradigma perampasan aset korporasi (asset recovery) lintas negara yang diperkuat dalam KUHP Baru (UU No. 1 Tahun 2023) sebagai instrumen efek jera yang mutlak, serta mempercepat pembentukan sistem komando tunggal keamanan laut untuk mengatasi ego sektoral antar-penyidik.
dc.description.abstractIllegal, Unreported, and Unregulated (IUU) Fishing practices pose a serious threat to marine sustainability. The capture of the Russian-flagged M/V Volga by Australia and its trial at the International Tribunal for the Law of the Sea (ITLOS) set an important precedent in the international law of the sea regarding hot pursuit, reasonable bond, prompt release, and forfeiture. This study aims to identify gaps in Indonesian fisheries law by comparing the law enforcement practices in the M/V Volga case with the national justice system. This study applies a normative legal research method with doctrinal and comparative approaches, analyzed using gap analysis. The results indicate that Indonesia's law enforcement mechanism still has procedural weaknesses when compared to UNCLOS 1982 standards and the jurisprudence of the Volga case. The national implementation of hot pursuit remains general and lacks the technicality of Article 111 of UNCLOS. Regarding the reasonable bond, although normatively recognized in Article 104 of the Fisheries Law, the absence of Government Regulations (PP) makes this mechanism inapplicable in practice. On the other hand, the auction management of perishable evidence through Article 45 of the Criminal Procedure Code (KUHAP) shares functional similarities with Australia's trust system, although its implementation is hampered by bureaucracy. It is concluded that Indonesia needs to maintain the paradigm of transnational corporate asset recovery, currently strengthened in the New Criminal Code (KUHP - Law No. 1 of 2023), as an absolute deterrent instrument, and accelerate the establishment of a single agency multi-tasks system for maritime security to overcome sectoral egos among investigators.
