Abstract: Konflik tenurial di kawasan hutan merupakan permasalahan yang kerap terjadi di Indonesia, yang umumnya disebabkan oleh tumpang tindih klaim hak atas lahan antara masyarakat adat, pemerintah, dan pihak lainnya. Penelitian ini bertujuan untuk mengkaji dinamika konflik tenurial, mulai dari penyebab, upaya penyelesaian, hingga keterkaitannya dengan peraturan perundang-undangan yang berlaku. Metode penelitian yang digunakan adalah deskriptif kualitatif melalui tinjauan pustaka sistematis atau systematic literature review terhadap 41 kasus konflik, serta 5 peraturan perundang-undangan. Berdasarkan hasil penelitian menunjukkan bahwa konflik tenurial di Indonesia disebabkan utamanya oleh faktor hukum seperti ketidakjelasan status lahan, tumpang tindih kebijakan, dan lemahnya perlindungan hak masyarakat. Metode penyelesaian paling banyak diterapkan adalah penegakan hukum, namun dengan tingkat keberhasilan yang rendah. Berbanding terbalik jika dibandingkan mediasi dan perhutanan sosial. Evaluasi terhadap peraturan perundang-undangan menunjukkan bahwa secara keseluruhan, regulasi terkait konflik tenurial tidak diperlukan rencana tindak, sehingga regulasi relatif baik dan efektif.
Tenurial conflict in forest areas is a common issue in Indonesia, generally caused by overlapping land claims among indigenous communities, the government, and other parties. This study aims to examine the dynamics of tenurial conflict, including its causes, resolution efforts, and its relationship with the prevailing legal frameworks. The research employed a descriptive qualitative method through a systematic literature review of 46 conflict cases and 5 pieces of legislation. The findings indicate that tenurial conflicts in Indonesia are primarily caused by legal factors such as unclear land status, overlapping policies, and weak protection of community rights. The most frequently applied resolution method is law enforcement, although it has a low success rate. In contrast, mediation and social forestry have demonstrated higher effectiveness. The evaluation of the legal frameworks shows that overall, regulations related to tenurial conflict do not require follow-up action plans, suggesting that the regulations are relatively sound and effective.
